കേരളത്തിൽ കുഴൽക്കിണർ കുഴിക്കുമ്പോൾ
ശ്രദ്ധിക്കേണ്ട നിയമങ്ങളും ദൂരപരിധികളും:
സ്വകാര്യ ഭൂമിയിൽ കുഴൽക്കിണർ (Tube well / Borewell)
നിർമ്മിക്കുന്നതിനുള്ള പ്രധാന നടപടിക്രമങ്ങൾ ചുവടെ പറയുന്നു.
- ഭൂഗർഭജല വകുപ്പിന്റെ അനുമതി (NOC):
o
അതത് ജില്ലാ ഭൂഗർഭജല വകുപ്പ് (Ground Water Department) ഓഫീസിൽ നിശ്ചിത ഫോറത്തിൽ അപേക്ഷ നൽകുക.
o
ഉദ്യോഗസ്ഥർ സ്ഥലം സന്ദർശിച്ച്
ഹൈഡ്രോജിയോളജിക്കൽ പരിശോധന നടത്തിയ ശേഷം സാധ്യതാ റിപ്പോർട്ടും അനുമതിപത്രവും (NOC) നൽകും.
- തദ്ദേശ സ്വയംഭരണ സ്ഥാപനത്തിന്റെ പെർമിറ്റ്:
o
ഭൂഗർഭജല വകുപ്പിന്റെ NOC സഹിതം
ബന്ധപ്പെട്ട ഗ്രാമപഞ്ചായത്ത് / നഗരസഭ / കോർപ്പറേഷൻ സെക്രട്ടറിക്ക്
അപേക്ഷ സമർപ്പിക്കുക. (അംഗീകൃത ബിൽഡിങ് ലൈസൻസി മുഖേന കെ - സ്മാർട്ട് പോർട്ടൽ വഴി)
o
കേരള പഞ്ചായത്ത്/മുനിസിപ്പാലിറ്റി
കെട്ടിട നിർമ്മാണ ചട്ടങ്ങൾ (KPBR/KMBR- ചട്ടം 75) പ്രകാരമുള്ള അനുമതി വാങ്ങുക.
o
ഭൂമിയുടെ ഉടമസ്ഥാവകാശം തെളിയിക്കുന്ന രേഖ
(ആധാരം, നടപ്പ് സാമ്പത്തിക വർഷത്തെ കരം രസീത്).
o
നിർദ്ദിഷ്ട കിണറിന്റെ സ്ഥാനം
വ്യക്തമാക്കുന്ന സൈറ്റ് പ്ലാൻ.
o
ഭൂഗർഭജല വകുപ്പിന്റെ എൻ.ഒ.സി (NOC).
o
അപേക്ഷാ ഫീസ്.-10 രൂപ
o
പെർമിറ്റ് ഫീസ് -20 രൂപ
- ദൂരപരിധിയും മാനദണ്ഡങ്ങളും:
o
അയൽ വസ്തുവിന്റെ അതിർത്തിയിൽ നിന്നും
സെപ്റ്റിക് ടാങ്ക്, ലീച്ച് പിറ്റ് തുടങ്ങിയ മലിനജല സ്രോതസ്സുകളിൽ നിന്നും
കെട്ടിട നിർമ്മാണ ചട്ടങ്ങൾ അനുശാസിക്കുന്ന നിശ്ചിത അകലം പാലിച്ചിരിക്കണം.

നിർമ്മാണ ചട്ടങ്ങൾ (KMBR / KPBR), ഭൂഗർഭജല വകുപ്പ് മാനദണ്ഡങ്ങൾ എന്നിവ പ്രകാരം
കുഴൽക്കിണർ നിർമ്മിക്കുമ്പോൾ പാലിക്കേണ്ട പ്രധാന ദൂരപരിധികൾ:
§ അയൽ വസ്തുവിന്റെ
അതിർത്തിയിൽ നിന്ന്: വസ്തുവിന്റെ മറ്റ് അതിരുകളിൽ നിന്ന് കുറഞ്ഞത് 1.20
മീറ്റർ അകലം പാലിക്കണം.
§ റോഡ് അതിർത്തിയിൽ
നിന്ന്: കെട്ടിട നിർമ്മാണ ചട്ടങ്ങൾ പ്രകാരം കെട്ടിടങ്ങൾക്ക്
ബാധകമായ അതേ റോഡ് സെറ്റ് ബാക്ക് (Setback from street/road) കുഴൽക്കിണറിനും
ബാധകമാണ്.
§ സെപ്റ്റിക് ടാങ്ക് /
ലീച്ച് പിറ്റ് എന്നിവയിൽ നിന്ന്: സ്വന്തം ഭൂമിയിലോ
അയൽ വസ്തുവിലോ ഉള്ള സെപ്റ്റിക് ടാങ്ക്, സോക്ക് പിറ്റ്,
ലീച്ച് പിറ്റ്, മാലിന്യക്കുഴികൾ എന്നിവയിൽ
നിന്ന് കുറഞ്ഞത് 7.5 മീറ്റർ ചുറ്റളവ് അകലം ഉറപ്പാക്കണം.
§ മറ്റ് കിണറുകൾ /
കുഴൽക്കിണറുകളിൽ നിന്നുള്ള അകലം: സമീപത്തെ മറ്റ്
കുടിവെള്ള സ്രോതസ്സുകളെയോ പൊതു കുടിവെള്ള പദ്ധതികളെയോ ബാധിക്കാതിരിക്കാൻ ഭൂഗർഭജല
വകുപ്പിന്റെ (Ground Water Department) ഹൈഡ്രോജിയോളജിക്കൽ
പരിശോധനാ റിപ്പോർട്ടിൽ നിഷ്കർഷിക്കുന്ന നിശ്ചിത സുരക്ഷിത അകലം പാലിക്കേണ്ടതാണ്.
§ പ്ലോട്ടിലെ
കെട്ടിടത്തിനുള്ളിലൊ അല്ലെങ്കിൽ കെട്ടിടത്തിനോട് ചേർന്നോ അല്ലെങ്കിൽ
കെട്ടിടത്തിൽ നിന്നും അകന്നോ കിണറിന്റെ സ്ഥാനമാകാവുന്നതാണ്.
§ പെർമിറ്റ് ലഭിച്ച് 5 വർഷത്തിനുള്ളിൽ
കിണർ നിർമ്മിച്ചിരിക്കേണ്ടതാണ്.
o
കുഴൽക്കിണർ നിർമ്മാണത്തിന് ഭൂഗർഭജല
അതോറിറ്റിയിൽ രജിസ്റ്റർ ചെയ്ത അംഗീകൃത ഏജൻസികളെയും റിഗ്ഗുകളെയും മാത്രമേ
ചുമതലപ്പെടുത്താവൂ.
Rules and Distance Limits to Consider
When Drilling a Borewell in Kerala
- The
main procedures for constructing a tube well or borewell on private land
are detailed below:
1. No Objection
Certificate (NOC) from the Ground Water Department
§ Apply in the
prescribed format to the respective District Ground Water Department office.
§ Officials will visit
the site, conduct a hydrogeological inspection, and subsequently issue a
feasibility report and No Objection Certificate (NOC).
2. Permit from Local
Self-Government Institution
§ Apply, along with the
Ground Water Department's NOC, to the concerned Grama Panchayat / Municipality
/ Corporation Secretary. (This must be done via the K-Smart portal through an
authorized building licensee).
§ Obtain permission as
per the Kerala Panchayat/Municipality Building Rules (KPBR/KMBR - Rule 75).
3. Required Documents
§ Proof of land
ownership (Title deed/Aadharam, and the current financial year's land tax
receipt).
§ A site plan clearly showing
the location of the proposed well.
§ NOC from the Ground
Water Department.
§ Application Fee: ₹10
§ Permit Fee: ₹20
Distance Limits and
Criteria
§ The specific
distances from the neighbor's property boundary and wastewater sources (like
septic tanks and leach pits), as prescribed by the building rules, must be
strictly maintained.
§ Key distance limits
to follow when constructing a borewell, according to the Local Self Government
Building Rules (KMBR / KPBR) and Ground Water Department guidelines:
- From the neighbor's property boundary: A minimum distance
of 1.20 meters must be maintained from the boundaries
of the property.
- From the road boundary: The same road setback applicable to
buildings as per the building rules also applies to the borewell.
- From septic tanks / leach pits: A minimum radial distance of 7.5
meters must be ensured from septic tanks, soak pits, leach
pits, and waste pits, whether they are on your own land or the
neighbor's property.
- Distance from other wells / borewells: To avoid affecting
nearby drinking water sources or public drinking water projects, a
specific safe distance prescribed in the hydrogeological inspection
report of the Ground Water Department must be maintained.
Additional
Guidelines:
§ The well can be
positioned inside the building on the plot, attached to the building, or away
from the building.
§ The well must be
constructed within 5 years of obtaining the permit.
§ Only authorized
agencies and rigs registered with the Ground Water Authority should be
contracted for the construction of the borewell.
